Short Sale vs. Foreclosures: the Neighborhood | Marshfield Real ...

This week, we are looking at the advantages of a short sale over a foreclosure from five different perspectives: Sellers?, Neighborhoods?, Banks?, Prices and the Children. ? The KCM Crew

A foreclosure, in most cases, leaves the block with a vacant home. A short sale does not. A vacant house in a neighborhood creates several challenges: It doesn?t contribute to the tax base of the region. It can be an eyesore and bring down the image of the area. It can be a breeding ground for insects (example: mosquitoes, ticks, etc.). It can be an incubator for crime if occupied by vagrants or transients. It can create safety issues for children (example: unguarded pool).

If a short sale is the result rather than a foreclosure, it is much better for the neighborhood .

Tomorrow, we will look at the impact of a short sale compared to a foreclosure on the banks.

Ghana producer price inflation hits 19.1 pct in June

ACCRA (Reuters) - Ghana's annual producer price inflation rose to 19.1 percent in June, the highest in nine months, the statistics office said on Wednesday, due in part to manufacturers having to pay more for imports due to a plunge this year in the cedi currency.

The statistical office revised down producer inflation for May to 16.6 percent, from 18.01 percent, as previously announced.

The West African nation's cedi currency has slipped by more than 17 percent against the dollar since January on persistent demand for imports to fuel the growing economy, which expanded 14.4 percent in 2011.

"The cedi's depreciation is a factor (in the jump in producer prices)," Magnus Ebo Duncan, director of economic statistics, told Reuters.

Producer prices in the world's second-largest cocoa producer rose 2.6 percent on the month, he said.

Duncan said producer prices in the manufacturing sector, which constituted more than two-thirds of total industry output, increased to 22 percent in June from 17.6 percent previously.

Uribe?shines as Dodgers top Mets

NEW YORK (AP) - Juan Uribe pulled on his shirt, broke into a grin and said, "Hallelujah!"

Uribe snapped out of a long slump with a homer and four RBIs, Chris Capuano pitched seven solid innings against his former team and the Los Angeles Dodgers defeated the staggering New York Mets 8-5 on Saturday.

"It was really great to see him get a couple of big hits tonight, especially that big one in the ninth," Capuano said.

Uribe hit an early two-run double to end a 1-for-38 slide. He added a two-run homer in the ninth inning off 13-game winner R.A. Dickey, making his first relief appearance since April 2011 to help an overtaxed Mets bullpen.

Matt Treanor also stopped a slump with a run-scoring hit and the Dodgers won their third straight following a 1-7 skid. Matt Kemp had an RBI triple and Capuano (10-5) struck out nine for his first victory in seven career starts against the Mets.

"Pretty much the same Cap. He just kind of keeps going," Dodgers manager Don Mattingly said. "That's pretty much what we've been getting every time out."

Los Angeles chased 41-year-old spot starter Miguel Batista (1-3) after three innings, getting into baseball's worst bullpen early for the second consecutive game. Both times, the Dodgers built a comfortable cushion and held on at the end.

Ronny Cedeno homered for the Mets (47-47), who have lost eight of nine to fall back to .500 for the first time since they were 13-13 after play on May 4. Before the game, they put struggling ace Johan Santana on the 15-day disabled list with a sprained right ankle, a move also meant to recharge his surgically repaired left shoulder.

"My shoulder is fine. I don't have any problems with it," Santana said. "I feel fine. It's just that you've got to (have) time to recover."

Capuano went 11-12 with a 4.55 ERA for New York last season, proving he was healthy enough to warrant a $10 million, two-year contract from the Dodgers. He came in 0-5 with a 5.86 ERA against the Mets, but held them to three runs on eight hits and a walk.

"I just had a great experience here last year, and I love the ballpark," Capuano said. "I've really enjoyed coming back."

Pinch-hitter Daniel Murphy delivered an RBI triple in the eighth off Ronald Belisario and scored on a groundout by pinch-hitter Kirk Nieuwenhuis to cut New York's deficit to 6-5.

James Loney singled with two outs in the ninth off Dickey, and Uribe drove a knuckleball to left for his second home run this season. He came off the disabled list June 11 after missing 28 games with a strained left wrist.

"Lucky today," Uribe said about his home run. "I feel good when I help my team win the game."

Dickey threw 111 pitches over 7 1-3 innings Thursday in Washington to improve to 13-1. Mets manager Terry Collins said Friday night he might use Dickey in relief late Saturday, his regular throw day between starts.

"I salute him for going in there. It's certainly something he's not used to doing, but that's the kind of guy he is - if you need me, I'll be there for you," Collins said.

Dodgers closer Kenley Jansen walked two in the ninth before striking out Scott Hairston for his 18th save.

Batista, who pitched in relief Wednesday, took Dillon Gee's turn and made his fifth start of the season. Gee had surgery last week to patch an artery in his pitching shoulder after a blood clot had formed there.

Working from the stretch even with the bases empty, Batista walked three batters in the first inning and gave up an RBI single to Loney.

Uribe, who began the day batting .186, hit a two-run double to right on a 1-2 pitch with two outs in the third. He also walked twice, and scored three runs for the first time since May 29, 2010.

"It was a big day for him and for us, obviously," Mattingly said. "It's just nice for him to feel like he's a part of it."

Luis Cruz added a run-scoring single to make it 4-0.

Batista was pulled for a pinch-hitter after throwing 81 pitches through three innings.

"It's hard when you haven't started a game in 61 days," he said.

It marked the second consecutive game in which the Mets' starter never even came to bat. Santana was yanked after three innings and 72 pitches Friday night. He allowed six runs and seven hits in a 7-6 loss, dropping to 0-3 with a 13.50 ERA in his past three outings - the worst stretch of his career.

"We've got to start getting some length out of our starters," Collins said.

Treanor snapped an 0-for-23 drought with a two-out RBI double in the fifth off Jeremy Hefner that extended the lead to 6-2.

NOTES: Treanor started behind the plate for the second consecutive game. Dodgers C A.J. Ellis had an MRI that revealed only inflammation in his left knee. Mattingly said Ellis will play Sunday in the series finale if he's cleared by the doctor. ... Morgan Stanley earnings fall sharply

Morgan?Stanley?said Thursday its revenue fell sharply in the second quarter, dragged down by weak results from its investment banking unit. Its net income missed Wall Street expectations, and its stock dropped sharply.

The bank brought in 24 percent less revenue overall, but the decline was especially evident in investment banking, where revenue plunged 37 percent.

In that unit, revenue from advising businesses was down by half. Bond and commodities sales and trading was down by nearly 60 percent. Stock sales and trading fell nearly 40 percent.

In a statement, CEO James Gorman described the April-June period as "an environment marked by investor caution."

The bank earned $564 million for the quarter, a swing from a loss of $558 million in the same period last year. In last year's second quarter,?Morgan?took big charges so it could cut down on expensive dividend payments to Mitsubishi UFJ Financial Group, a Japanese financial firm that gave the bank a life-sustaining cash infusion in the depths of the 2008 financial crisis.

Earnings came to 29 cents per share, lower than the estimate of 32 cents from analysts surveyed by FactSet, a data provider.

Morgan?Stanley?stock was down 68 cents, or 4.9 percent, to $13.99 in premarket trading. The stock was above $30 as recently as February 2011.

The revenue decline is an unwelcome trend for?Morgan?Stanley, but one it shares with most of its peers.

Bank of America, Citigroup, JPMorgan Chase and Goldman Sachs all reported lower revenue. Only Wells Fargo reported higher revenue, mostly because it issued more mortgage loans.

Besides Wells Fargo, the five other banks rely heavily on their investment banking units, which can offer spectacular gains in good times but carry more risk in a weak economy and when financial markets are choppy.

The results also underscore why Gorman is so eager to buy up the rest of?Morgan?Stanley?Smith Barney, the retail brokerage that?Morgan?Stanley?owns with Citigroup.?Morgan?Stanley?wants to raise its stake to 65 percent from 51 percent and is haggling over a price with Citi.

Brain satnav helps surgeons travel to a tumour

SATNAV is good at finding the easiest route to where you want to go. Now a version for the brain could allow a flexible probe to take the safest route to reach deep tissue. Together, the algorithm and probe could provide access to brain tumours that were previously deemed inoperable.

When surgeons want to take a biopsy from deep inside the brain, they face a problem - how to get there without damaging the brain tissue en route. Flexible needles are one solution. Ferdinando Rodriguez y Baena at Imperial College London and colleagues created such a probe in 2009, basing the design on the needle-like ovipositor that female wasps use to deposit eggs inside trees.

Just like the wasp's ovipositor, the probe has a number of interlocking flexible shafts, each of which can slide independently of the others. The probe naturally sticks to the soft brain tissue, providing traction, which means that when one of the shafts slides further into the tissue the probe will flex. By controlling the relative movement of each shaft it is possible to send the probe snaking along a path through the tissue.

Rodriguez y Baena's team has now begun to think about exactly which paths are best to take. "Some areas of the brain are more important than others and we needed a way to decide what route caused the least amount of damage to vital areas," says team member Seong Young Ko at Chonnam National University in Gwangju, South Korea. "You would want to stay well away from major blood vessels and sensory areas, for example."

The team has now developed an algorithm to direct the probe around these obstacles. It considers three factors: the distance from the scalp to the desired brain tissue, the proximity of the route to vital areas such as blood vessels or nerve bundles, and the accumulated risk along the way.

There is controversy over how to rate the importance of different parts of the brain, so the team tested the algorithm by giving arbitrary levels of importance to different areas. It revealed the path which should theoretically bring the least risk to a patient. Ko presented the algorithm at the BioRob 2012 conference in Rome, Italy, last month.

"The ability to take a curved path through the brain, selecting the most forgiving route to avoid critical regions, represents an intriguing breakthrough," says Katrina Firlik, a neurosurgeon in Greenwich, Connecticut, who was not involved in the research. "It could not only enhance safety but might even expand the surgical repertoire to include cases currently deemed inoperable."

That is the hope, says Ko. So far the probe has only been tested in animal tissue, but he says the goal is to use the algorithm to guide the safe implantation of electrodes deep in the brain and to improve the safety of taking biopsies from hard-to-reach tumours.

Senate panel approves Russia trade, rights bill

WASHINGTON (Reuters) - The Senate Finance Committee on Wednesday unanimously approved a bill to ensure U.S. exporters share in the benefits of Russia's accession to the World Trade Organization but also to punish Russian officials for human rights violations.

The legislation still faces an uphill battle to be passed before U.S. elections in November because of concern over Russia's ties to Syria and Iran that make it a politically difficult vote for some lawmakers.

But supporters hoped the committee's strong bipartisan vote improved chances the full Senate and House of Representatives will consider the bill before U.S. lawmakers leave in two weeks for their month-long recess and Russia joins the WTO in August.

"If we miss that deadline, American farmers, ranchers and businesses will lose out to the other 154 members of the WTO," Senate Finance Committee Chairman Max Baucus, a Democrat, said.

In addition, including new human rights legislation in the trade bill makes it unsavory to Moscow, which views those provisions as an intrusion in its affairs.

The Obama administration welcomed the committee's vote on a combined trade and human rights bill, but it said its main priority was establishing "permanent normal trade relations," or PNTR, by terminating a Cold War-era provision known as the Jackson-Vanik amendment.

That measure is at odds with WTO rules requiring members to give equal treatment to exports from all other members on an unconditional basis and is the reason that Congress is under pressure to pass the trade legislation.

"We applaud the Senate Finance Committee's action today, and look forward to working with Congress to advance America's interests with regard to Russia's WTO accession as quickly as possible," U.S. Trade Representative Ron Kirk said.

The 1974 Jackson-Vanik amendment tied favorable U.S. tariff rates on Russian goods to the rights of Russian Jews to emigrate freely. It is mostly symbolic now because both Democratic and Republican administrations have judged Russia to be in compliance since the 1990s. But it remains on the books.

If Congress does not act, Russia could deny U.S. firms some of the market-opening concessions it made to join the WTO, putting those companies at a disadvantage to foreign competitors in one of the world's 10-largest economies.

"Given the slow growth of our economy and continued high unemployment rate, we simply cannot allow that to happen," said Senator Orrin Hatch, the panel's top Republican.

Earlier on Wednesday, the upper house of Russia's parliament overwhelmingly passed legislation to implement the commitments Moscow made to join the WTO. Once Russian President Vladimir Putin signs the bill and formally notifies the WTO, Russia will become the newest member in 30 days.

QUICK ACTION REQUIRED

U.S. lawmakers have fewer than 12 legislative days left before their month-long August recess, requiring quick action in both chambers of Congress to get the trade bill approved.

But the White House push to pass PNTR comes at a low point in U.S.-Russia relations, with many U.S. lawmakers angry over Moscow's support for the government of Syrian President Bashar al-Assad in the face of a 16-month-old uprising.

Many lawmakers also are loathe to lift the Jackson-Vanik amendment without passing new legislation to punish Russia for perceived human rights abuses.

That prompted Baucus to add the so-called "Magnitsky bill," already passed by two other congressional committees, to the Russian trade bill.

It is named after Sergei Magnitsky, an anti-corruption Russian lawyer who died in 2009 after a year in Russian jails.

The measure directs the State Department to publish the names and deny visas to people believed responsible for the detention, abuse or death of Magnitsky, and for the Treasury Department to freeze their assets.

It would also punish other human rights abusers in Russia or anywhere in the world, and allow certain members of Congress to suggest individuals to be put on the sanctions list.

"What this bill does is hold gross violators of internationally recognized human rights accountable," said Senator Ben Cardin, a Democrat who has been a driving force behind the Magnitsky bill.

Moscow strongly opposes the Magnitsky bill.

"Really, the last thing we want is for the anti-Soviet Jackson-Vanik amendment to be replaced with anti-Russian legislation," Deputy Foreign Minister Sergei Ryabkov was quoted as saying on Wednesday by Interfax news agency.

Both the Democratic Obama administration and House Ways and Means Committee Chairman Dave Camp, a Republican, have said they would prefer a "clean" PNTR bill, free of any human rights provision that would irritate relations with Russia.

But on Wednesday, Camp said he welcomed "the news that the Finance Committee was able to pass bipartisan Russia PNTR legislation today and will carefully study the bill once legislative text is available."

Camp also said he planned to introduce his own PNTR bill "in the next few days." He said he was working with the White House to find a Democratic co-sponsor for the legislation in the hopes of winning committee approval as soon as possible.

However, top Democrats on the Ways and Means panel urged Camp to take up the Senate Finance Committee version.

"We should get Russia PNTR done now -- and this bipartisan bill from the Senate Finance Committee is the right approach," Representative Jim McDermott said.

Red Cross: Syria conflict now a civil war

DAMASCUS, Syria (AP) ? Syria's 16-month bloodbath crossed an important symbolic threshold Sunday as the international Red Cross formally declared the conflict a civil war, a status with implications for potential war crimes prosecutions.

The Red Cross statement came as United Nations observers gathered new details on what happened in a village where dozens were reported killed in a regime assault. After a second visit to Tremseh on Sunday, the team said Syrian troops went door-to-door in the small farming community, checking residents' IDs and then killing some and taking others away.

According to the U.N., the attack appeared to target army defectors and activists.

"Pools of blood and brain matter were observed in a number of homes," a U.N. statement said.

Syria denied U.N. claims that government forces had used heavy weapons such as tanks, artillery and helicopters during the attack Thursday.

Syrian Foreign Ministry spokesman Jihad Makdissi said the violence was not a massacre ? as activists and many foreign leaders have alleged ? but a military operation targeting armed fighters who had taken control of the village.

"What happened wasn't an attack on civilians," Makdissi told reporters Sunday in Damascus. He said 37 gunmen and two civilians were killed ? a far lower death toll than the one put forward by anti-regime activists, some of whom estimated the dead at more than 100.

"What has been said about the use of heavy weapons is baseless," Makdissi added.

The U.N. has implicated President Bashar Assad's forces in the assault. The head of the U.N. observer mission said Friday that monitors stationed near Tremseh saw the army using heavy weaponry and attack helicopters.

The fighting was some of the latest in the uprising against Assad, which activists say has killed more than 17,000 people. Violence continued Sunday, with more clashes reported around the capital, Damascus.

The bloodshed appeared to be escalating. On Sunday, the International Committee of the Red Cross said it now considers the Syrian conflict a civil war, meaning international humanitarian law applies throughout the country.

Also known as the rules of war, humanitarian law grants all parties in a conflict the right to use appropriate force to achieve their aims. The Geneva-based group's assessment is an important reference for determining how much and what type of force can be used, and it can form the basis for war crimes prosecutions, especially if civilians are attacked or detained enemies are abused or killed.

"We are now talking about a non-international armed conflict in the country," ICRC spokesman Hicham Hassan said.

War crimes prosecutions would have been possible even without the Red Cross statement. But Sunday's pronouncement adds weight to any prosecution argument that Syria is in a state of war ? a prerequisite for a war crimes case.

Previously, the Red Cross committee had restricted its assessment of the scope of the conflict to the hotspots of Idlib, Homs and Hama. But Hassan said the organization concluded that the violence was widening.

"Hostilities have spread to other areas of the country," Hassan said. "International humanitarian law applies to all areas where hostilities are taking place."

Although the armed uprising in Syria began more than a year ago, the committee had hesitated to call it a civil war ? though others, including United Nations officials, have done so.

That is because the rules of war override ? and to some extent suspend ? the laws that apply in peacetime, including the universal right to life, right to free speech and right to peaceful assembly.

When the Red Cross says something "it's always very persuasive," said Louise Doswald-Beck, a professor of international law at the Geneva Graduate Institute. In legal terms, that means a court would be unlikely to decide differently.

As an internal conflict officially becomes a civil war, the security environment shifts from regular law enforcement to a situation in which international law permits the government to attack rebel fighters, Doswald-Beck said.

"That's why this whole business of Tremseh is interesting," she said.

Stephen M. Saideman, professor at the Norman Paterson School of International Affairs in Ontario, Canada, doubted whether the Red Cross declaration would change anything significant on either side.

Assad and his supporters won't stop fighting or change their tactics because they have too much to lose, Saideman said. The opposition "can have their spirits lifted by this, but they have been fighting a civil war for quite a while. So it is not clear how this announcement improves much their ability to recruit or to reduce divisions among the many rebel groups."

On Saturday, U.N. observers entered Tremseh, a community of 6,000 to 10,000 people in a farming region along the Orontes River northwest of the city of Hama. They found pools of blood in homes, along with spent bullets, mortars and artillery shells. The evidence added to the emerging picture of what anti-regime activists have called one of the deadliest events of the uprising.

Dozens of bodies have already been buried in a mass grave or burned beyond recognition, and activists were struggling to determine the number of people killed. Estimates range from 100 to more than 150 dead.

Activists expect those figures to rise since hundreds of residents remain unaccounted for. Locals believe some bodies are still in nearby fields and others were probably dumped in the river.

Some of the evidence suggested that, rather than the outright shelling of civilians depicted by the opposition, the violence in Tremseh may have been a lopsided fight between the army pursuing the opposition and activists and locals trying to defend the village. Nearly all of the dead are men, including dozens of armed rebels.

Independent verification of the events is nearly impossible in Syria, one of the Middle East's strictest police states, which bars most media from working independently within its borders. The observers are in the country as part of a faltering peace plan by U.N. special envoy Kofi Annan, who has been trying for months to negotiate a solution to Syria's crisis.

Although much of the international community has turned on Assad, Damascus still has some key allies ? including Russia and Iran. The Kremlin announced Sunday that Annan will meet President Vladimir Putin on Tuesday.

Also Sunday, Iranian Foreign Minister Ali Akbar Salehi said Tehran is ready to invite Syrian opposition groups and government envoys for talks, the semiofficial ISNA news agency reported.

Any proposal from Iran is likely to be rebuffed by rebel groups, which have rejected negotiations with Assad's government and have criticized Tehran for standing by its allies in Damascus. But the offer suggested Iran is seeking a more active role in mediation efforts after Annan's visit last week to Tehran.

PHILADELPHIA (AP) ? Joe Paterno and other top Penn State officials hushed up child sex abuse allegations against Jerry Sandusky more than a decade ago for fear of bad publicity, allowing Sandusky to prey on other youngsters, according to a scathing internal report issued Thursday on the scandal.

"Our most saddening and sobering finding is the total disregard for the safety and welfare of Sandusky's child victims by the most senior leaders at Penn State," said former FBI Director Louis Freeh, who was hired by university trustees to look into what has become one of sports' biggest scandals. "The most powerful men at Penn State failed to take any steps for 14 years to protect the children who Sandusky victimized."

After an eight-month inquiry, Freeh's firm produced a 267-page report that concluded that Hall of Fame coach Paterno, President Graham Spanier, athletic director Tim Curley and vice president Gary Schultz "failed to protect against a child sexual predator."

Freeh called the officials' disregard for child victims "callous and shocking."

"In order to avoid the consequences of bad publicity, the most powerful leaders at the university ? Spanier, Schultz, Paterno and Curley ? repeatedly concealed critical facts relating to Sandusky's child abuse," the report said. Paterno "was an integral part of this active decision to conceal," Freeh said at a news conference.

School leaders "empowered Sandusky to attract potential victims to the campus and football events by allowing him to have continued, unrestricted and unsupervised access" to campus and his affiliation with the football program, the report said. The access, the report states, "provided Sandusky with the very currency that enabled him to attract his victims."

Freeh said officials had opportunities in 1998 and 2001 to step in.

Sexual abuse might have been prevented if university officials had banned Sandusky from bringing children onto campus after a 1998 inquiry, the report said. Despite their knowledge of the police probe into Sandusky showering with a boy in a football locker room, Spanier, Paterno, Curley and Schultz took no action to limit his access to campus, the report said.

The May 1998 complaint by a woman whose son came home with wet hair after showering with Sandusky didn't result in charges at the time. The report says Schultz was worried the matter could be opening "Pandora's box."

Then, in 2001, after a member of Paterno's staff saw Sandusky in a campus shower with a boy, officials did bar him from bringing children to campus and decided not to report him to child welfare authorities.

"There's more red flags here than you could count over a long period of time," Freeh said.

Sandusky is awaiting sentencing after being convicted of 45 criminal counts for abusing 10 boys. The scandal led to the ouster of Paterno and Spanier. Curley and Schultz are awaiting trial on charges accusing them of lying to a grand jury and failing to report abuse. They have pleaded not guilty.

Trustee Anthony Lubrano, a critic of the board's dismissal of Paterno in November, said the board was still formulating a response.

Freeh also said Sandusky's conduct was in part a result of the school's lack of transparency, which stemmed from a "failure of governance" on the part of officials and the board of trustees. He said the collective inaction and mindset at the top of the university trickled all the way down to a school janitor who was afraid for his job and opted to not report seeing sex abuse in a school locker room in 2000.

The report also singled out the revered Penn State football program ? one built on the motto "success with honor" ? for criticism. It says Paterno and university leaders allowed Sandusky to retire in 1999, "not as a suspected child predator, but as a valued member of the Penn State football legacy, with future 'visibility' at Penn State'," allowing him to groom victims.

Investigators, however, found no evidence linking his $168,000 retirement package in 1999 to the 1998 police investigation. Freeh called the payout unprecedented but said there was no evidence it was an attempt to buy Sandusky's silence.

Sandusky's trial last month included gut-wrenching testimony from eight young men who said he abused them as boys, sometimes on campus, and included testimony that showed he used his prestige as a university celebrity to manipulate the children.

By contrast, Freeh's team focused on Penn State and what its employees did ? or did not do ? to protect children.

More than 430 current or former school employees were interviewed since November, including nearly everyone associated with the football program under Paterno. The Hall of Fame coach died of lung cancer in January at age 85, without telling Freeh's team his account of what happened.

The report included a series of emails among school administrators following accusations against Sandusky in 1998 and 2001.

After Curley opted not report Sandusky for an alleged assault of a boy in the football locker room showers in 2001, Schultz called the decision to try and get Sandusky to seek professional help "humane." But he also noted that "the only downside for us is if the message isn't (heard) and acted upon and we then become vulnerable for not having reported it."

The emails also point to Paterno being aware of the 1998 accusation.

With the report now complete, the NCAA said Penn State now must address four key questions concerning "institutional control and ethics policies," as outlined in a letter sent to the school last fall.

"Penn State's response to the letter will inform our next steps, including whether or not to take further action," said Bob Williams, the NCAA's vice president of communications. "We expect Penn State's continued cooperation in our examination of these issues."

The U.S. Department of Education is examining whether the school violated the Clery Act, which requires reporting of certain crimes on campus, including ones of a sexual nature. The report said Penn State's "awareness and interest" in Clery Act compliance was "significantly lacking."

Only one form used to report such crimes was completed on campus from 2007 through 2011, according to the Freeh findings. And no record exists of Paterno, Curley or assistant coach Mike McQueary reporting that McQueary saw Sandusky in a shower with a boy in 2001, as they would be obligated to do under the Clery Act.

As of last November, Penn State's policies for Clery compliance were still in draft form and had not been implemented, the report found.

U.S. Department of Education said it was still examining whether Penn State violated the Clery Act, but declined to comment on Freeh's report.

Mary Krupa, an 18-year-old Penn State freshman who grew up in State College, said the conclusion that the school's highest officials were derelict in protecting children didn't shake her love of the town or the school.

"The actions of five or six people don't reflect on the hundreds of thousands" of students and faculty who make up the Penn State community, she said while walking through the student union building on campus.

Freeh said he regretted the damage the findings would do to Paterno's "terrific legacy" but there was no attempt to pin the blame on the late coach.

"What my report says is what the evidence and the facts show," he said.

Christian Beveridge, a masonry worker who grew up near Penn State, said the findings will ruin Paterno's legacy but not the closeness that people in town and fans feel for him.

"He built this town," said Beveridge, 40, resting in the shade on campus during a break. "All of his victories, he'll be remembered by everyone in town for a long time, but there will be that hesitation."

US, allies press Assad as top Syrian general flees

PARIS (AP) ? U.S. Secretary of State Hillary Rodham Clinton on Friday hailed an accelerating wave of defections in President Bashar Assad's inner circle as the United States and its international allies pleaded once again for global sanctions against the Syrian regime. Frustrated by the slow pace of diplomacy, Clinton lambasted Russia and China for standing in the way.

Speaking after a 100-nation conference in Paris, Clinton said Syria's "regime insiders and the military establishment are starting to vote with their feet" by abandoning the four-decade Assad dynasty. She spoke after Western officials reported top Assad aide aide Brig. Gen. Manaf Tlass had left the country.

"Those with the closest knowledge of Assad's actions and crimes are moving away," Clinton told reporters. "We think that is a very promising development. It also raises questions for those remaining in Damascus, who are still supporting this regime."

Tlass' departure from Syria provided welcome news for the U.S. and its European and Arab partners after another gathering of the "Friends of Syria" group that demonstrated the international community's continued inability to end 16 months of bloodshed that activists say has killed some 14,000 people.

The defection of Tlass, a member of the elite Republican Guards and a son of a former defense minister, is the first major crack in the upper reaches of Assad's regime, which has remained largely cohesive throughout the uprising.

Tlass has not spoken publicly since his defection and his whereabouts remain unknown, though French Foreign Minister Laurent Fabius announced that the general was en route to France, where Tlass' sister lives. Fabius later backtracked, saying he was not sure of Tlass' final destination.

Even those closest to him "are starting to realize that you cannot support a butcher like Mr. Bashar Assad," Fabius said.

Hassem Hashimi, a member of Syria's opposition National Council, said the development could open more cracks in Assad's power base. "The defection of Tlass will encourage a lot of similar people to defect as well," he told The Associated Press in Paris.

As the son of longtime Defense Minister Mustafa Tlass, the general was a member of the Syrian Baath Party aristocracy, part of a privileged class that flourished under the Assad dynasty. He also was one of the most important Sunni figures in Syria's Alawite-dominated regime.

Tlass' father and Assad's father, Hafez, had been close friends since their days in the Syrian military academy in Homs and became even closer after being posted to Cairo in the late 1950s when Egypt and Syria merged into the United Arab Republic ? a union that lasted three years. After Hafez Assad rose to power in the early 1970s, Mustafa Tlass became defense minister and the Syrian president's most trusted lieutenant.

When Hafez died of a heart attack in 2000, Tlass helped engineer Bashar's succession to the presidency and guided the inexperienced young doctor. Tlass was the leader of a coterie of old regime figures that critics blamed for reining in moves to liberalize the Syrian regime.

Clinton referred to Tlass as a "very close and long-time ally of Assad and his father."

"These defections send a message to Assad, but perhaps more importantly they send a message to those still left, which I hope they hear and heed," she told reporters. "We have no doubt about the outcome here. We know that the Assad regime will fall. The question is how many more people will have to die before that happens. We want to see those on the inside hasten the day when a new transition can begin."

The gathering in France's capital aimed to win wider support for a Syrian transition plan unveiled last week by U.N. mediator Kofi Annan. Joined by America's allies, Clinton called for "real and immediate consequences for non-compliance, including sanctions," against the Assad regime.

But with neither Moscow nor Beijing in attendance, much remained dependent on persuading the two reluctant U.N. veto-wielding powers to force Assad into abiding by a cease-fire and the transition strategy. Clinton urged governments around the world to direct their pressure toward Russia and China as well.

"What can every nation and group represented here do?" Clinton asked. "I ask you to reach out to Russia and China, and to not only urge but demand that they get off the sidelines and begin to support the legitimate aspirations of the Syrian people."

"I don't think Russia and China believe they are paying any price at all ? nothing at all ? for standing up on behalf of the Assad regime," she added. "The only way that will change is if every nation represented here directly and urgently makes it clear that Russia and China will pay a price. Because they are holding up progress, blockading it. That is no longer tolerable."

It's unlikely the latest in a serious of U.S. pleas for Russian cooperation on Syria will help. The increasing exasperation with Moscow is partly a reflection of American powerlessness to stop the violence, with the Obama administration having effectively ruled out a military intervention or providing weapons to Syria's rebels.

That leaves the United Nations and the paths of increasing the economic pressure on Assad's regime and its political isolation. Russia and China have twice blocked U.N. condemnations of Syria's government and just last weekend worked to water down Annan's transition plan so that the Syrian leader and the opposition would have vetoes over interim government candidates.

The Kremlin rejected the anti-Assad call on Friday, with Deputy Foreign Minister Gennady Gatilov quoted by the Interfax news agency as saying that Clinton's comments contradicted Annan's plan, which Washington and Moscow agreed to.

Despite limited space for action, British Foreign Secretary William Hague said, "We don't rule out any option for the future because it is deteriorating.

"It is a murdering regime, so we want to see a peaceful transition," he said, "but we are not ruling anything out."

Syrian rebels said sanctions weren't working and expressed a preference for quick military action. New violence in Syria led many activists to dismiss the importance of the Paris meeting. Anti-regime activists say Syrian forces have killed at least 25 people, arrested scores more and torched dozens of homes while seizing the northern city of Khan Sheikhoun from rebels.

At the conference, opposition member Hashimi called for a no-fly zone to prevent military forces from "flying over defected soldiers and civilians and bombarding them."

"We're sick of meetings and deadlines. We want action on the ground," said activist Osama Kayal, speaking via Skype from an area near Khan Sheikhoun.

In Paris, Burhan Ghalioun, former leader of the Syrian National Council, explained his frustration.

"I am not satisfied at all because the Syrians are not waiting for press communiques. What preoccupies the Syrians today is the way we can stop the massacre. Every day there are 100, 130, 150 victims and the people only think about that," he said. "They want action. They want measures and (a) practical mechanism to stop the killings."
